Arrow End to Ford suit delayed

Nov 19, 2007 (The Sacramento Bee - McClatchy-Tribune Information Services via COMTEX) -- F | charts | news | PowerRating -- The anticipated ending in the multibillion-dollar civil suit against Ford Motor Co. has been postponed -- again -- in Sacramento Superior Court for reasons that were not clear on Monday.

Outside of Department 1, the court calendar had noted that a hearing in the Ford trial was scheduled for 8:30 a.m. on Monday's date, but the doors remained locked and the courtroom stayed vacant.

A courthouse spokeswoman said she was awaiting word when the case would resume. One of the lawyers involved in the litigation said they would return on Dec.3.

In early October, Judge David De Alba, who is hearing the case without a jury, announced that he was confident both parties were close to an "apparent resolution" in the $2-billion suit.

The case, heard over the summer, centers on whether Ford violated California's unfair competition and false advertising laws when it marketed its Ford Explorers as safe family-friendly SUVs in the 1990s. Plaintiffs claim Ford knew of a fatal design flaw that made the vehicles prone to rolling over.

The suit was filed on behalf of the more than 414,000 Californians, including Sacramento County residents, who brought Ford Explorers at the time and claim their vehicles plummeted in resale and trade-in value following reports of rollover accidents and the nationwide recall of the Explorers' Firestone tires.

Ford attorneys had argued in court that Explorers were safe and had sometimes ranked at the top of their class in consumer reviews.

They pointed to other market factors, including the onset of a recession and the burst of the Internet bubble, to explain the vehicles' depreciation over time.

Attorneys have since declined to comment.
